Social Security Disability

WHAT IS SOCIAL SECURITY DISABILITY, AND AM I ELIGIBLE?

If you have become disabled and are unable to work as a result, you may qualify for Social Security Disability (SSDI) benefits.  Under the federal Social Security system, in order to be eligible for disability benefits, you must have earned enough work credits from your recent employment, and your physical or mental condition must be severe enough to preclude you from performing your past work or adapting to other work.  If you have a condition or disability that prevents you from working, please contact our experienced attorneys at Agnelli Law Office for a free consultation today.   We are here to help.

HOW DO I APPLY FOR SOCIAL SECURITY DISABILITY?

Pursuing Social Security Disability benefits can be an overwhelming and complicated task.  Agnelli Law Office is here to assist you through the entire process, so that you can focus on your health and well-being.   We file your application for you electronically, help you in completing any forms that you receive, and provide all medical documentation and other necessary evidence for your claim.

DO I NEED AN ATTORNEY TO HANDLE MY CASE?

Statistics from the Social Security Administration show that 70% of all initial disability applications are denied.    Often claims are denied simply because they don’t receive all of the medical or other necessary documentation to properly evaluate and prove your claim.  Our attorneys have over twenty-five years’ experience helping clients navigate this process and avoid the many pitfalls.   Studies have shown that hiring an experienced Social Security Disability attorney can significantly increase your chances of getting disability benefits.

WHAT IF MY CLAIM IS DENIED?

If your claim is denied, we will file the appropriate appeals, and represent you at a hearing if necessary.    Our team at Agnelli Law Office will stay on top of updates, meet deadlines, write letters to Judges on your behalf and routinely provide updated evidence for your claim.   A properly worked-up case can also aid in cutting down wait times for a decision.

HOW MUCH WILL MY MONTHLY BENEFIT BE IF I AM APPROVED?

If you are found disabled by Social Security, your monthly disability benefits are based on the amount of income on which you have paid social security taxes.  In 2022, the average monthly benefit amount paid to an SSDI recipient is around $1,358 but can go as high as around $3,345 a month for those whose income was fairly high in recent years.   You can find out an accurate estimate of your benefit amount by going onto www.ssa.gov and creating an account under “My Social Security”.

WILL I BE ELIBLE FOR ANY MEDICAL COVERAGE IF I’M APPROVED?

Yes.   If you are approved for Social Security Disability, you will be eligible for Medicare after a 24-month qualifying period.  You can sign up for both Part A (hospital insurance) and Part B (medical insurance).   Most people pay a monthly fee for Part B.

HOW MUCH DOES YOUR FEE COST?

Agnelli Law Office only receives a fee if you win your claim.    You will never pay any out-of-pocket expenses for our services.   Attorney fees are determined by the Social Security Act.  This is limited to 25% of the retroactive or “past-due” benefits you are awarded.  This fee is capped at a maximum of $7,200, the attorney will receive whichever is less.   If your claim is not approved, we will not receive a fee.
